Ferber turned in his draft card to William Sloane Coffin, Jr., who delivered it, along with 280 others, to the U.S. Justice Department in October 1967. In January, 1968, Ferber was indicted on conspiracy charges, along with Coffin, Dr. Benjamin Spock, and others. Although declared guilty, the decision was reversed in the U.S. Court of Appeals in July, 1969, on grounds that the "Boston 5" were denied a fair trial. He was supported by the Defense Committee.
